| This theory dealt with one of the basic pillars of the Islamic judiciary, intellectually, systematically, and applied reality, represented by the general theory of judicial responsibility in Islamic legislation, which is a model for the extent of the development of Islamic legislative thought, especially in preserving human rights and its entity in an optimal manner, and this analytical study came to present this theory in light of the intensification of civilizational conflict between nations in the field of legal and judicial thought, so it was necessary to present the theory of judicial responsibility in Islamic legislation, to manifest through it The validity of the Sharia is applicable at all times and places, especially at this time. Responsibility as a general idea in Islamic legislation, organizes several applications, and has its own dimensions spacious, but judicial responsibility is the general theory that has its origins, effects, and horizons, all if its components are met; The author of the theory, “Dr. Amjad Ali Saadeh”, has worked hard through his study of the topics and issues of responsibility in a scientific thesis, to work to prove this theory by indicating its sources, and the conditions that must be met in it, and then addressing it with an analytical study of the pillars represented: the official, the questioner, the person responsible before him, and the person responsible for him, all through a statement of what it is, and the related issues through which the nature of the right and its origins are determined, leading to a statement of the effects of the completion of judicial responsibility, which inflicts on the parties to judicial responsibility: The questioner, and the official, whether by ruling on jurisdiction and obligation, or compensation and guarantee, or rehabilitation and punishment, and the judge may combine more than one effect when the actual application of judicial responsibility. This thesis reached to prove that responsibility in the Islamic judiciary has its origins and components, and entails its effects with a careful explanation and deep research, printed in a book entitled “The General Theory of Judicial Responsibility in Islamic Legislation” issued by the House of Culture in Jordan 2010, the researcher also presented an integrated formulation of the general theory of judicial responsibility in Islamic legislation, represented a conclusion to this thesis and a summary of the content of this theory | |
